Process draft CF-001

SYN-028

The right of reply (reference: AfrikaBurn WELL)

As an in-ecosystem reference for respondent fairness: an incident report is complete only once the respondent has been informed of the complaint with as much information as reasonable and given a right of reply — notified personally and in writing, with the option of a meeting, a month to respond, and the reply given in writing so it is fairly recorded (discussion may supplement but never replaces the written record). The reply is considered before any outcome is decided, its contents may be checked with involved parties, receipt is acknowledged within days, and timely replies get a committed decision window. The right to reply is distinct from an appeal.

Deliberately left open — Whether Jozi adopts a formal right-of-reply and on what timelines is open; it interacts with CF-001's survivor-centred concerns (Stage 2 evidence pending).

  • WELL-036 Completion of the incident report includes ensuring the respondent is informed of the complaint with as much information as is reasonably possible, and has a right of reply to the complaint/allegations. This aims to provide a fair opportunity for response.
  • WELL-037 The participant is notified of the complaint: Telephonically or in person in writing via email
  • WELL-038 The respondent may be invited to meet with the relevant organisation representatives.
  • WELL-039 The respondent has 1 month within which to reply to the complaint from the date on which they’re notified.
  • WELL-040 Reply may be discussed in person but must be conveyed in writing in order to be fairly represented on record.
  • WELL-041 Reply may be supplemented by in-person discussion but discussion will not be the primary record or reference.
  • WELL-042 The respondent’s reply is taken into consideration before an outcome is determined and communicated.
  • WELL-043 Note: The content of the participant’s reply may require confirmation and subsequent discussion with involved parties.
  • WELL-044 The right to reply is not the same as an appeal (see ‘Appeals’ below).
  • WELL-045 Once a reply has been received from a respondent, a ‘receipt of reply’ will be conveyed by the relevant party on behalf of AfrikaBurn within 5 working days.
  • WELL-046 The organisation will then seek to determine and convey the outcome of the WELL process by end October if the reply has been timeously received.
  • WELL-047 A reply received later than September may encounter unavoidable delays in response and resolution.
