Process draft OD-011OD-015

SYN-029

Appeals (reference: AfrikaBurn WELL)

As an in-ecosystem reference: outcomes can be appealed once per incident, by the person the complaint concerns, with notice within a month of the outcome. Appeals rest on new information or perspectives — repeating the original reply is not grounds and may be dismissed; a genuine apology is welcomed as repair but does not itself justify an appeal; process feedback gets a reply but is not automatically grounds either. Appeal routes differ by category, each convening an appropriate review panel with cross-organisation oversight.

Deliberately left open — Whether Jozi's process includes appeals at all, and who would hear them, is open (OD-011/OD-015 territory).

  • WELL-059 Outcomes reached – and the measures determined – through the WELL process may be appealed.
  • WELL-060 Appeals may be brought by the participant who is the subject of complaint.
  • WELL-061 In the interests of effective and timeous outcomes, the appeal process consists of one appeal only per incident.
  • WELL-062 Notice of intent to appeal should be received by the organisation not longer than 1 month after notification of outcomes.
  • WELL-063 The appeals process rests primarily on new information or perspectives being brought forth.
  • WELL-064 Repeating the same information and perspectives as contained in the initial reply – and therefore already reasonably considered by the organisation – doesn’t constitute grounds for appeal and may lead to an appeal being dismissed or not successful.
  • WELL-065 A genuine forthcoming apology by the respondent, is welcome as part of the journey towards repair, but can not be the sole basis for the granting of an appeal. The respondent will be provided with a reply.
  • WELL-066 A respondent is welcome to provide feedback regarding the process, however this will not necessarily constitute grounds for an appeal. The respondent will be provided with a reply.
  • WELL-067 Regarding Harm to people, appeals to be directed to well@afrikaburn.com or star@afrikaburn.com who will convene an appropriate review panel.
  • WELL-068 Regarding Risk to culture to Exco@ whereby Exco will provide all documentation to the Board’s Culture and Ethics Subcommittee (Cultcom) to convene a review panel involving individuals across the organisation.
  • WELL-069 Regarding Damage to (theft of) property to Exco@ whereby Operations will convene a review panel involving external providers as required.
